$195,000 Settlement for Local Philadelphia Area School Teacher.
A local Philadelphia area school teacher was assaulted during working hours, resulting in neck, back and head injuries. The injured worker had undergone significant treatment for her work related injuries which prevented the injured worker from returning to work. The local school district employer did not have a position for the injured worker to return to perform, so a labor market survey and earning power assessment was performed by the worker’s compensation insurance company. Jobs were located for the injured worker and the worker’s compensation insurance carrier instituted litigation attempting to modify/reduce the amount of the wage loss benefits the injured worker had been receiving. The injured worker was represented by Philadelphia worker’s compensation lawyer Jonathan B. Koutcher of Pearson Koutcher, LLP. Mr. Koutcher challenged the opinions of the vocational counselor who performed the labor market survey and called into question whether the jobs were within the injured worker’s physical restrictions. Mr. Koutcher was able to secure a settlement after months of negotiations and attending a mediation session.
