$192,000 Lump Sum Settlement with Open Medical for Union Building Engineer
Pearson Koutcher Law partner Jonathan Koutcher represented a union building engineer in Philadelphia who suffered a lower back injury while at work. Mr. Koutcher defended the injured worker against a Petition to Modify Compensation Benefits, as the employer was attempting to reduce the injured worker’s wage loss benefits by alleging the injured worker had earning power based upon a labor market survey. In addition, the worker’s compensation insurance company alleged that the injured worker fully recovered from his work related lower back injuries. Despite ongoing litigation, Mr. Koutcher successfully negotiated a settlement with the employer and its insurance company, whereby the injured worker received a lump sum of $192,000 to settle the wage loss portion of the claim. The injured worker was still able to receive ongoing medical treatment as a negotiated term of the settlement.
