$150,000 Lump Sum Settlement with open Medical for Montgomery County Union Tree Worker.
A longtime union employee for a tree cutting company injured his shoulder requiring surgical intervention. The worker’s compensation insurance company initially denied the claim. Philadelphia worker’s compensation attorney, Jonathan B. Koutcher, of Pearson Koutcher, LLP, fought and won the case for the injured worker. This allowed the injured worker to undergo surgery to his injured shoulder. The injured worker then returned to work on light duty. Mr. Koutcher was able to obtain partial disability benefits for the injured worker as he returned to work earning less than his pre injury average weekly wage. The injured worker would have been able to receive partial disability benefits for up to 500 weeks. Mr. Koutcher was able, however, to obtain a lump sum settlement for the injured worker exceeding the amount he would still be entitled to receive in partial disability benefits.
