Your employer notifies its workers’ compensation insurer and reports the injury when required.

Can You Choose Your Own Doctor?
Sometimes. You may need to treat with an employer-approved provider for the first 90 days, but only if your employer has followed Pennsylvania’s notice and provider-list requirements. After that, you can generally choose your own doctor.
What If Your Employer Says the Injury Is Your Fault?
Pennsylvania workers’ compensation is generally a no-fault system. You may still qualify for benefits even if your own mistake contributed to the accident, as long as the injury happened in the course of your job.
What If You Had a Previous Injury?
A pre-existing condition doesn’t automatically prevent you from receiving benefits. If your job aggravated, reactivated, or accelerated the condition, it may still qualify as a work injury.
Can I sue someone other than my employer?
Possibly. If a contractor, driver, property owner, equipment manufacturer, or another third party caused your injury, you may have a separate claim in addition to workers’ compensation. Any recovery may affect the benefits already paid, so both claims should be handled together.
