No, you are not required to return to work if you receive a Notice Of Ability To Return To Work. In Pennsylvania, the workers’ compensation insurance company is required by law, when it receives medical evidence that an injured worker can return to work in any capacity, to provide prompt written notice to an injured worker advising the following: the nature of the injured worker’s physical condition or change in condition; that the injured worker has an obligation to look for available employment; that proof of available employment may jeopardize the injured worker’s right to receive ongoing benefits; and that the injured worker has the right to consult with an attorney. This information is sent to an injured worker on a Bureau of Workers Compensation Form, called a “Notice of Ability to Return to Work” (FORM LIBC 757).
