Pearson Koutcher Law Attorney Jonathan Koutcher wins Claim Petition for Hearing Loss Benefits for Delaware County Union Electrical Worker
Pearson Koutcher Law partner Jonathan Koutcher was successful in litigating a Claim Petition for a Delaware County union electrical worker who alleged hearing loss as a result of the hazardous occupational noise to which he was exposed over years of employment. The insurance company for the employer denied the claim and sent the injured worker for an independent medical evaluation to an ear, nose and throat physician who rendered an opinion that the cause of the injured worker’s hearing loss was due simply to the aging process. Mr. Koutcher presented testimony from the injured worker’s ear, nose and throat physician who presented an alternate theory of hearing loss, namely that the injured worker was exposed to hazardous occupational noise while working for the employer. Mr. Koutcher also presented the injured worker’s testimony before the Judge. At that time the injured worker was able to explain to the Judge the type of noise he was exposed to at work, the frequency and duration of the noise and how he did not have any hobbies outside of work which exposed him to loud noise. The injured worker was awarded hearing loss benefits based upon his percentage of binaural hearing impairment established by audiogram. The injured worker now has the ability to receive treatment for his work-related hearing loss, including hearing aids.
