$99,000 Lien Reduction for Injured Worker with a Third Party Case!
An injured janitor and maintenance worker from Philadelphia severely injured his lower back and foot, both of which required surgery, when he fell into a large hole at work. The injured worker had been out of work and receiving wage loss benefits. The injured worker was represented by Jonathan Koutcher, Esq of Pearson Koutcher Law. Since the injured worker’s injuries were due to the negligence of a third party, the injured worker was able to pursue and settle a third party case for a significant, confidential sum of money. However, since the injured worker was still receiving worker’s compensation benefits when the third party case settled, the injured worker needed to “pay back” a portion of his settlement, to the worker’s compensation insurance company. In addition, the injured worker’s future wage loss and medical benefits were reduced significantly as a result of the future credit that was associated with the lien pay back. Mr. Koutcher had previously litigated several petitions successfully for the injured worker, including a Petition to Suspend Compensation Benefits filed by the employer alleging an appropriate job was offered to the injured worker. Given the lien pay back and the reduced future benefits, Mr. Koutcher negotiated a settlement for the injured worker that was the equivalent of 13 years of benefits at the injured worker’s reduced benefit rate.
