Jonathan B. Koutcher, Esquire, founding partner of Pearson Koutcher Law, settled the case of a Lancaster county ironworker who injured his wrist requiring surgery. The injured worker fell at a job site in Washington, DC. The Workers’ Compensation insurance company began paying the injured worker Workers’ Compensation benefits under the Pennsylvania Workers’ Compensation Act. The injured worker was hired by a Pennsylvania company in Pennsylvania. The injured worker began complaining of symptoms in his neck which radiated down his arm. Mr. Koutcher filed a petition to review compensation benefits to include additional injuries as alleged by the injured worker. Mr. Koutcher presented the injured worker for testimony and took the deposition testimony of the injured worker’s trading orthopedic surgeon. After attending a mediation, the parties were able to settle this case while preserving the injured worker’s rights to proceed with a third-party lawsuit against the negligent general contractor at the job site.
