Attorney Jonathan B. Koutcher of Pearson Koutcher Law successfully litigated a Claim Petition for an injured warehouse worker. The granting of the Claim Petition results in the injured worker receiving over one (1) year of back due wage loss benefits as well as continued and ongoing wage loss benefits into the future. The Workers’ Compensation insurance company is also obligated to pay for medical treatment that is reasonable, necessary and related. In this case, the injured worker sustained injuries to the upper back and neck region at work. The Workers’ Compensation insurance company denied the claim initially. The injured worker testified before the Judge, and Mr. Koutcher cross examined the employer fact witness, whose testimony was not found credible by the Judge. In addition, Mr. Koutcher presented the testimony of the injured worker’s treating orthopedic surgeon, who diagnosed the injured worker with a traumatic cervical and trapezius strain, C-7 radiculopathy and post concussion syndrome.
