The Steps to Take After a Workplace Injury
The choices you make early can shape your treatment, wage-loss benefits, and the strength of your claim.
Here’s what to do next:
01
Notify Your Employer
Report the injury to your supervisor as soon as possible, even if it seems minor. Delayed notice can put your benefits at risk.
02
Get Medical Care
Ask where to go and explain how the injury happened. Employer-directed treatment may apply for 90 days if PA’s requirements were met.
03
Keep a Record
Write down when, where, and how you were hurt. Keep photos, witness details, pay stubs, medical records, and claim paperwork.
04
Follow Your Restrictions
Give your employer your doctor’s written limits. Don’t perform work outside those restrictions or return before you’re cleared.
05
Call a Lehigh Valley Workers’ Comp Lawyer
Get legal help if your claim is denied, payments are late, treatment is questioned, or you’re pushed back to work too soon.
What Workers’ Comp Benefits May Cover
Pennsylvania workers’ compensation may cover treatment costs and part of the income you lose while recovering. The benefits available depend on your injury and how it affects your ability to work.
We explain more about how worker’s comp is calculated in our full blog post.
Medical Treatment Benefits
Coverage may include doctor visits, surgery, therapy, medication, hospital care, and medical equipment related to the injury.
Wage Loss Benefits
If you can’t work or have to accept a lower-paying position, you may qualify for partial income replacement.
Specific-Loss Benefits
Additional compensation may be available for permanent loss of use, amputation, or lasting hearing or vision loss.
Disfigurement Benefits
Serious, permanent scarring or disfigurement to the head, face, or neck may qualify for compensation.
Death Benefits
Eligible family members may receive ongoing payments and help with burial costs after a fatal work injury.
Pearson Koutcher Law helps injured workers across Allentown, Bethlehem, Easton, and the wider Lehigh Valley understand which benefits may apply to their claims.

How the PA Workers’ Comp Process Works
After you report a work injury, your employer and its insurer begin reviewing the claim. Here’s how the process typically moves forward.
01
Your Employer Reports the Injury
Your employer notifies its workers’ compensation carrier and completes any required reporting.
02
The Claim Is Reviewed
The insurer looks at how the injury occurred, your medical records, your wages, and whether the condition is job-related.
03
The Insurer Responds
Your claim may be accepted, temporarily accepted while the investigation continues, or denied.
04
Benefits May Begin
An accepted claim can cover approved medical care and provide wage-loss payments if the injury affects your earnings.
05
A Petition May Be Filed
If benefits are denied or disputed, your attorney can file the appropriate petition. The case is then assigned to a Pennsylvania workers’ compensation judge.
06
The Case Is Resolved
Lehigh Valley claims may involve hearings, medical evidence, witness testimony, negotiations, or settlement. If no agreement is reached, the judge issues a decision.
Pearson Koutcher guides injured workers through each stage and handles the legal work required to move the case forward.
Accepted Claim? You May Still Need Protection
Approval doesn’t mean the insurance company can’t challenge your claim later.
You may need legal help if:
- Your checks are late, reduced, or incorrect.
- The insurer accepted only part of your injury.
- Recommended treatment is delayed or denied.
- You’re scheduled for an independent medical examination.
- Your employer pushes you back to work too soon.
- A modified-duty job exceeds your restrictions.
- The insurer seeks to reduce, suspend, or end your benefits.
- You receive a settlement offer that could close future wage or medical benefits.
Pearson Koutcher Law helps workers protect claims that are already open, not just appeal initial denials.
Talk to us before an insurance request, job offer, or settlement changes your benefits.

Questions About Workers’ Comp? Start Here.
Can You Choose Your Own Doctor?
In some cases. Your employer may require you to use an approved provider for the first 90 days, but only if it followed Pennsylvania’s provider-list and notice rules. Once that period ends, you can generally choose your own doctor.
What If Your Employer Says the Injury Is Your Fault?
Workers’ compensation in Pennsylvania is generally no-fault. You may still be eligible for benefits even if you made a mistake, provided the injury happened while you were doing your job.
What If You Had a Previous Injury?
Yes. An older injury or pre-existing medical condition may qualify if your work duties aggravated it, caused it to return, or made it worse.
Can I sue someone other than my employer?
Possibly. If a driver, contractor, property owner, equipment manufacturer, or another outside party contributed to the injury, you may have a separate third-party claim alongside workers’ compensation. Because one recovery can affect the other, both claims should be evaluated together.
